A former Menlo Ventures principal is set to be deposed over a deleted post saying she had shifted most of her listening from Spotify to Suno, a statement the major-label plaintiffs may use while challenging Suno’s fair-use defense.
Digital Music News reports that C.C. Gong’s deposition is expected within 30 days. Universal Music and Sony Music are seeking testimony and investor materials touching on due diligence, Suno’s copyright exposure and the potential market impact of AI-generated music.
The legal importance is not that one social-media post decides the case. It is that fair-use analysis can examine market substitution. A public claim that AI listening replaced Spotify listening gives the plaintiffs a concrete line of inquiry, while Suno can still contest the meaning, context and admissibility of that evidence.
